Employment: automated decision systems.
Summary
This California bill prohibits employers from using automated decision systems (ADS) in certain ways—such as to infer a worker's protected status, conduct predictive behavior analysis, or identify workers exercising legal rights—and requires employers who use ADS to assist in discipline, termination, or deactivation decisions to have a human reviewer independently investigate and provide workers with written notice and access to their data. The bill applies to all employers in California, including state and local government, and authorizes the Labor Commissioner, workers, and public prosecutors to enforce it through citations, civil actions, and penalties up to $500 per violation.
