AQUIFER PROTECTION ACT

This Illinois bill prohibits data centers from using water from the Mahomet Aquifer starting January 1, 2027, and requires existing data centers to switch to alternative water sources by January 1, 2028. It bars state agencies from issuing permits for aquifer groundwater withdrawal by data centers and prevents local governments from keeping data center water use information confidential through nondisclosure agreements. The bill establishes penalties for violations and grants the Illinois Environmental Protection Agency authority to create implementing rules.
